DEATH ANGEL X TASCAM SWEEPSTAKES RULES
1. Sponsor
Nuclear Blast America Inc. 701 S Carson St Ste 200, Carson City, NV 89701 (the “Sponsor”) organizes with the participation of Death Angel (the “Artist”) a free Sweepstakes, with NO PURCHASE NECESSARY TO ENTER OR WIN, from December 9th, 2021 to January 31st, 2022 at midnight, accessible online only (the “Sweepstakes”). The Contest will take place on Instagram (the “Social Media”). However, the Contest is in no way sponsored, endorsed or administered by, or associated with, the Social Media.
2. Eligibility
The Sweepstakes is open only to legal residents of the 50 United States and Washington D.C aged 18 years or over at the time of their participation (the “Participants”), except employees of the Sponsor and its affiliated companies, or of its suppliers, service providers, agents or any third party directly associated with the administration of the Sweepstakes, as well as their family and household members. Each Participant can only participate once (same name and/or address and/or phone number and/or email address).
3. How to Enter
o enter the Sweepstakes, the Participant must : • Be physically present in the 50 United States and Washington D.C, • On the Social Media, o Repost the Sweepstake post; o And tag (1) a friend he/she would invite to a Death Angel concert, (2) Tascam, (3) Death Angel on the Instagram sweepstake post. • Follow both Tascam and Death Angel on Instagram. The Participant is responsible for all service costs associated with entering the Sweepstakes (if any), such as internet connection costs. The Participant will not be able to request reimbursement of such costs from the Sponsor.
4. Selection of winner(s)
5 winners will be chosen by a computer processed random draw within 15 days following the end of the Sweepstakes, from all Participants (the “Winners”). The odds of winning depends on the number of eligible entries received. The Winner(s) will be contacted by private Instagram message within 7 days following the draw (the “Notification”) and must provide in answer his/her name, email, postal address where the prize will be sent, and phone number. Other Participants will not be contacted by the Sponsor. 1 For a list of Sweepstakes Winners, if you are a resident of FL, MD, MA, NY, RI or TN, mail a self-addressed, stamped envelope after the end of the Sweepstakes, to the Sponsor at the address above (article 1). Residents of VT may omit postage.
5. Prizes
The randomly selected Winner(s) will win the following prizes: • 1st prize: 1 Professional-grade 4K UHD Blu-ray player https://tascam.com/us/product/bd-mp4k/top MSRP - $799 And the Death Angel Blu-Ray • 2nd prize, for each of the 5 other Winners: 1 Bass XL Monitoring Headphones TH-06 Tascam https://tascam.com/us/product/th-06/top MSRP - $99 And the Death Angel Blu-Ray PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. These prizes cannot be substituted (including for cash) or exchanged. The prizes delivery will be undertaken by the Sponsor, at their cost, by post, within 30 days of the Notification. Any prize which cannot be delivered or is sent back to the Sponsor for reasons not attributable to the Sponsor (wrong address provided, no answer from the Participant, etc.) can be claimed by the Winner for up to 1 month following the Notification. After this time, the prize can no longer be claimed and there will be a redraw conducted in the same way as the original draw. All prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
6. Liability
The Sponsor shall not be held responsible for Force Majeure events, or any event beyond the Sponsor’s reasonable control, affecting the Sweepstakes. In such a case, the Sponsor can, at its sole discretion, cancel, modify, shorten or prolongate the Sweepstakes, or replace the advertised prize with another prize of similar value. 2 The Sponsor is not responsible for any delay or failure to receive Notification for any reason, including inactive account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor the email account. Liability for any applicable taxes and any other expenses not specifically provided for by the Sponsor in these Rules are the sole responsibility of the Winner. By entering the Sweepstakes, you agree to be bound by these Rules and to release and hold the Sponsor, all its affiliates, subsidiaries, advertising and promotions agencies, and each of their respective agents, representatives, officers, directors, shareholders, employees and assigns, harmless from any and all liability arising out of your participation in this Sweepstakes including, without limitation, with respect to the awarding, receipt, use and/or misuse of any prize or cancellation of the Sweepstakes. Winner participates in the use of the prize with knowledge of the risks involved and agrees to accept them.
7. Personal Information
Personal Information (Social Media handle) provided by the Participant upon his/her entering the Sweepstakes or by the Winner following the Notification (name, email, postal address where the prize will be sent, and phone number), will be processed by the Sponsor based on the consent of the Participants. Personal Information will be stored in an electronic file and are necessary for the processing of the Sweepstakes’ participation, determination of the Winners, and delivery of the prizes. To comply with its obligation to make available information that indicates that a valid draw took place, the Sponsor will send the surname, State and winning entry of Winners, to residents of FL, MD, MA, NY, RI, TN or VT who requests them by post. Personal Information will be accessible only to Death Angel, the Sponsor’s marketing teams and to the Sponsor’s service providers involved with the Sweepstakes operation (if any). The Participant can access his/her Personal Information stored by the Sponsor, correct it or request it to be erased, or ask for the Sponsor to send him/her a copy of said information. 8. Miscellaneous
Participation to the Sweepstakes implies unconditional acceptance of these Sweepstakes rules. Any Participant in breach of these rules or trying to increase his/her chances to win by fraud, in any way whatsoever, can be excluded from the Sweepstakes.

This Sweepstakes is subject to federal, state and local laws with venue in New York County in the State of New York, and except where prohibited, you agree 3 that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court in the State of New York. The remedy for any claim will be limited to actual damages, and in no event will any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
